“We are happy with today’s decision. The Obama EPA has been acting like a schoolyard bully. It has routinely broken the laws, ignoring the limits to its authority established by Congress and usurping theauthority of the states to determine their own environmental standards.
“In doing so, they have run roughshod over anything or anyone. They have destroyed jobs at a time when millions across this country are desperate to find work. They have tried to impose a regulatory regime thatamounts to forced economic suicide for this country.
“Coming so closely on the heels of similar federal court rulings with regard to other components of the EPA’s regulatory assault on coal mining and coal-fired power generation, today’s decision by a three-judgepanel of the U.S. District Court of Appeals, D.C. Circuit overturning the agency’s Cross-State Air Pollution Rule (CASPR), offers a glimmer of hope that in the end common sense will prevail.
“The Courts recognize the Obama EPA for what it has become … a rogue agency that respects no limits to its authority. These decisions are part of an attempt to bring the agency to heel and restore the proper balancebetween the federal government and the states, between the executive branch and Congress and between concern for the environment and the jobs for people.
“We welcome today’s ruling, but the fight is far from over. Americans want to work. West Virginia’s coal mining families want to work. They don’t want a handout. They don’t want false promises. It is time to endthe nation’s EPA-imposed economic suicide and rebuild America. It’s time to put our people back to work.”
