The Attorneys General of West Virginia and Kentucky –Patrick Morrisey and Jack Conway – have joined with the Attorneys General of ten other states in litigation in the United States Court of Appeals for the District of Columbia challenging the authority of the United States EPA to issue standards of performance for existing power plants under Section 111(d) of the Clean Air Act, which were proposed on June 18, 2014.
It is widely believed that the standards as proposed would deal a crushing blow to the economies of states that produce coal as well as those states whose industries rely on electricity produced from coal and to the residents of these same states. The State of West Virginia and the Commonwealth of Kentucky are expected to be among the states most adversely affected by the EPA proposal.
General Morrisey and General Conway will be present to explain the basis of their bipartisan legal effort to spare their states the consequences of this unprecedented federal intrusion in the production and consumption of energy.
