October 31, 2008-- The West Virginia Department of Environmental Protection (WV DEP) has delivered its draft 303(d) list of impaired state waters to the federal Environmental Protection Agency (EPA) for review and approval. Under the federal Clean Water Act, states are required to identify impaired waters and the pollutants leading to that impairment. The streams are then scheduled for the implementation of improvement plans referred to as Total Maximum Daily Loads (TMDL) that regulate point and non-point source contributions to the watershed, typically reducing the thresholds for regulated parameters that can be assigned in NPDES permitting.
